1. Agreement to Terms

By accessing or using Paid Panelist ("the Service"), operated by Paid Panelist, LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

2. Eligibility

To use Paid Panelist, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information
• Maintain the security of your account credentials

By using the Service, you represent and warrant that you meet all eligibility requirements. We may suspend or terminate accounts that violate these requirements.

3. Service Description

Paid Panelist is an aggregator service that compiles opportunities across multiple panels and platforms that offer paid market research, paid testing, and various gigs to earn money. Our Service:

• Aggregates publicly available study listings from third-party platforms
• Provides personalized alerts based on user preferences
• Offers tools to search, filter, and bookmark opportunities
• Does not guarantee acceptance into any research study
• Does not verify, endorse, or guarantee the legitimacy of listed studies

4. Subscriptions & Billing

Free Tier

We offer a free tier with limited access to study alerts and features. Free tier users have access to studies older than 24 hours and limited platform coverage.

Paid Subscriptions

Premium subscriptions ("Pro" and "Enterprise") provide additional features including real-time alerts, all platform coverage, semantic search, and priority support.

• Subscriptions are billed in advance on a monthly or annual basis
• Prices are in USD and may be subject to applicable taxes
• Payment is processed securely through Stripe
• Subscription automatically renews unless cancelled before the renewal date

Cancellation & Refunds

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods
• Annual subscriptions may be eligible for a pro-rated refund within 14 days of purchase if no premium features were used

5. Acceptable Use Policy

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Scrape, crawl, or use automated tools to extract data without permission
• Attempt to gain unauthorized access to our systems or other users' accounts
• Distribute malware, spam, or malicious content
• Harass, abuse, or harm other users
• Create multiple accounts to circumvent restrictions or abuse promotions
• Resell, redistribute, or commercially exploit our Service without authorization
• Interfere with or disrupt the Service's infrastructure
• Provide false information to qualify for studies you are not eligible for

Violation of this policy may result in immediate account suspension or termination.

6. Third-Party Platforms & Disclaimers

Paid Panelist aggregates information from third-party research platforms. Important disclaimers:

• No Affiliation: We are not affiliated with, endorsed by, or partnered with the research platforms we compile from (e.g., Respondent, User Interviews, etc.)
• No Guarantee: We do not guarantee the accuracy, availability, or legitimacy of any listed study
• No Responsibility: We are not responsible for your interactions with third-party platforms or researchers
• User Responsibility: You are solely responsible for verifying study legitimacy and protecting your personal information when applying
• Platform Terms: Your use of third-party platforms is subject to their own terms of service

We make reasonable efforts to filter out suspicious listings, but we cannot guarantee complete protection against scams.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Paid Panelist, LLC and are protected by copyright, trademark, and other intellectual property laws.

• The Paid Panelist name, logo, and branding are our trademarks
• Our software, code, and proprietary algorithms are our property
• You may not copy, modify, or create derivative works without permission
• Third-party study content remains the property of its respective owners

8. User-Generated Content

If you submit content to our Service (e.g., feedback, testimonials, profile information):

• You retain ownership of your content
• You grant us a non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Service
• You represent that you have the right to submit such content
• We may remove content that violates these Terms or is otherwise objectionable

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Paid Panelist, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Dispute Resolution

Informal Resolution

Before filing a formal dispute, you agree to contact us at legal@paidpanelist.com to attempt informal resolution for at least 30 days.

Binding Arbitration

Any dispute not resolved informally shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English, and judgment may be entered in any court of competent jurisdiction.

Class Action Waiver

You agree that any disputes will be resolved individually and you waive the right to participate in a class action lawsuit or class-wide arbitration.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware.
